"Ostatnia Warta" Foundation

1. General Provisions

1.1. These regulations set out the rules for making online donations to the "Ostatnia Warta" Foundation based in Gdańsk (80-288), ul. Bronisława Czecha 1/9, entered into the Register of Associations, Other Social and Professional Organizations, Foundations, and Independent Public Health Care Facilities under KRS number: 0001224367, NIP: 9571199614, REGON: 544069163 (hereinafter referred to as the "Foundation").

1.2. Donations are used exclusively for the implementation of the Foundation's statutory goals, with particular emphasis on supporting chronically and terminally ill individuals, people with disabilities, seniors (including those struggling with dementia), as well as individuals in particularly difficult life, health, or financial situations.

1.3. Making a donation is entirely voluntary, and a Donor may be any natural person, legal entity, or organizational unit.

1.4. The collected funds are allocated in particular to financing or co-financing the costs of medical treatment (including foreign treatment), medical procedures, rehabilitation, purchase of medications, medical equipment, specialized transport, and to support the fulfillment of basic living needs of the Beneficiaries.

2. Methods of Making Donations and Commission Policy

2.1. The Foundation provides links and references to various forms of financial support on its website (https://ostatniawarta.pl/zbiorki.html).

2.2. Direct transfer (Recommended – 0% commission): The most efficient form of support, free of any external operator commissions, is a direct bank transfer to the Foundation's official account listed on the Foundation's website https://ostatniawarta.pl/. By choosing this method, the Donor can be sure that 100% of the funds paid will be fully allocated to public benefit goals and supporting the Foundation's Beneficiaries.

2.3. Online payments (External operators): The Foundation also allows quick payments through external partners (including Zrzutka.pl, Patronite, PayPal, FaniMani, BuyCoffee). Funds raised this way are transferred to the Foundation's account after commissions and handling fees have been deducted by the given payment operator, in accordance with their pricing.

3. Role of the Foundation vs. External Payment Operators (Important)

3.1. The Foundation's website plays a strictly informational and redirecting role in the online payment process.

3.2. After clicking on a selected support method (button, link, widget), the Donor leaves the Foundation's website environment and is redirected to the external, encrypted platform of the chosen payment operator.

3.3. All payments are processed based on the regulations, privacy policies, and technical capabilities of the given payment operator.

3.4. At no time does the Foundation collect, access, or process Donors' payment card details, CVV/CVC numbers, or online banking login credentials. This process occurs entirely outside the Foundation's IT infrastructure.

4. Security and Donor's Obligations

4.1. The Foundation makes every effort to ensure that the technical aspects of the ostatniawarta.pl website and the redirecting links placed on it are secure and defect-free.

4.2. Due to the nature of the Internet network, the Donor has a legal obligation to exercise due diligence. Before approving any online payment, the Donor is obliged to ensure they are on the correct, SSL-certified website of the payment operator and verify that the recipient of the funds is the correct entity (the "Ostatnia Warta" Foundation or a verified fundraiser for the Foundation).

5. Complaints and Refunds

5.1. Since the Foundation is not the technical operator of online payments, any complaints regarding transaction issues (e.g., double billing, authorization errors, interrupted payments) should first be reported directly to the Customer Service Office of the operator through which the payment was made (e.g., PayPal, Zrzutka.pl, and other operators available on our website: https://ostatniawarta.pl/zbiorki.html).

5.2. The Foundation may intervene or process a claim on its part only after the complaint procedure with the payment operator has concluded, and only if the disputed funds have actually and effectively credited the Foundation's final bank account.

5.3. Donations properly and successfully credited to the Foundation's account are, by their nature, non-refundable, subject to strict exceptions provided for by absolutely binding legal provisions (Civil Code).

6. Personal Data Protection (GDPR) and Terms of Service

6.1. The "Ostatnia Warta" Foundation is the controller of the Donor's personal data only to the extent such data is generated in the technical process of visiting the website (e.g., cookies) and to the extent voluntarily provided to the Foundation by the external payment operator following a successful transaction (usually limited to: first name, last name, e-mail address, and donation amount, for accounting and acknowledgment purposes).

6.2. All details regarding data processing are included in the Privacy Policy.

6.3. Use of our website, including clicking on payment links, is also subject to the general Terms of Use.

7. Final Provisions

7.1. The governing law for these Terms is Polish law. Any disputes arising from the use of the Service are subject to the exclusive jurisdiction of the common courts competent for the seat of the "Ostatnia Warta" Foundation in Gdańsk.
