I. IMPORTANT: Binding position of the Foundation and status of information
- Informational nature: All materials, descriptions, and documents available on the Website are for informational and illustrative purposes only. Various pieces of information may be located in different sections of the site, so it should be reviewed in its entirety.
- Binding position: Any substantively binding position, decisions, or official information from the "Ostatnia Warta" Foundation can only be obtained through official e-mail correspondence (kontakt@ostatniawarta.pl) or by post.
- Taking action: Making decisions based on fragmented or self-interpreted content from the Website is done at the User's sole risk.
II. Service availability, cybersecurity, and disclaimer
- "As is" basis: Our Website is provided on an "as is" and "as available" basis. The Service may be incomplete, partially updated, undergoing technical maintenance, temporarily unavailable, or substantively incomplete.
- Compatibility: Even though the Website relies on the common and secure HTML standard, the Foundation does not guarantee that the site will be 100% compatible with every User device (including older smartphone models, unusual operating systems, or outdated browsers).
- Good faith: The Foundation makes every effort to ensure the Service is continuously available, up-to-date, and error-free. Our activities are conducted in good faith, bearing in mind the best interests of our Beneficiaries and Donors.
- Geopolitical context: Given the ongoing armed conflict beyond Poland's borders and the involvement of third parties and nations (including the USA, where global domain and hosting infrastructure is often physically located), there is an elevated risk of cybersecurity incidents.
- Disclaimer of liability: The Foundation cannot be held legally or financially liable for potential Service unavailability, content tampering by third parties (defacement), code decompilation, DDoS attacks, malware infections, or other unpredictable events and threats in the Internet network that are beyond our direct control.
- Response time (SLA): In the event of a critical failure or an attack on the infrastructure, the Foundation declares a standard response time of 24 hours. During this time, our technical team will make all necessary attempts to repair, secure, or restore the Service using available backups.
- Bug reporting: Online safety is a shared responsibility. If a User finds a technical error (bug), a security vulnerability, or unusual Service behavior, they are obliged to promptly report this fact to the e-mail address: kontakt@ostatniawarta.pl, simultaneously refraining from exploiting the discovered vulnerability in bad faith.
III. Partners and third-party services (Payments and Fundraisers)
- As part of the support section, the Website uses external payment operators and fundraising platforms (e.g., Zrzutka.pl, Patronite, PayPal, FaniMani, BuyCoffee).
- The Website's role in this process is strictly informational and redirecting. After clicking a support link, the User leaves our site and is transferred to the operator's encrypted environment, where separate regulations and privacy policies apply.
- The Foundation does not collect and has no access to payment card data or online banking login credentials.
- Any technical complaints regarding financial transactions must first be reported directly to the Customer Service Office of the respective payment operator (in accordance with our Donation Terms).

V. Data Protection (GDPR)
- The data controller of your personal data (regarding digital footprints, e.g., cookies) left while browsing the website is the Foundation. Details on data processing, including analytical tools, can be found in our Privacy Policy.
VI. Termination of use and Final Provisions
- We reserve the right to refuse access to the Website or ignore inquiries in the event of a violation of these Terms, attempted fraud, cyberattacks, or harassment of Foundation members.
- The governing law for resolving disputes and interpreting these Terms is Polish law. Any disputes will be settled by Polish common courts competent for the seat of the "Ostatnia Warta" Foundation in Gdańsk.
