1. These Regulations set forth the rules, scope, and forms of assistance provided by the "Ostatnia Warta" Foundation (hereinafter referred to as the "Foundation"), based in Gdańsk.

The Foundation's operations are based on respect for human dignity and the selfless support of chronically and terminally ill individuals, people with disabilities, seniors, people in particularly difficult life, health, or financial situations, and their families, in accordance with the goals specified in the Foundation's Statute.
3. Whenever these Regulations refer to:
1. All assistance provided by the Foundation to Beneficiaries is entirely free of charge.

3. Granting one form of assistance does not guarantee the automatic granting of another.
1. Preliminary Consultations: Submitting an application is an important decision. We encourage you to contact us prior to taking formal steps to discuss your situation. 2. Submitting the Application: The condition for initiating the procedure for granting assistance is completing and signing the "Application for care" (along with the GDPR clause). The application may be submitted by the patient themselves, their legal guardian, or a relative who actually provides care for them.
3. Hybrid Procedure (Scans and Originals): To maximize the speed of verification, the complete application (scans of signed documents) should first be sent to the Foundation's e-mail address: kontakt@ostatniawarta.pl. However, to issue a final decision and launch actual assistance, it is essential to send the original documents via traditional post to the Foundation's official registered address.
4. Medical Documentation and Targeted Fundraisers: A copy of valid medical documentation confirming the state of health must be attached to the application. In the case of qualification for financial aid and the launch of a dedicated targeted fundraiser (e.g., on the Zrzutka.pl platform), the Foundation will strictly require the delivery of original or officially certified copies of medical documentation and itemized treatment estimates. This requirement stems directly from strict financial law regulations and the rules of external payment operators (especially after exceeding statutory fundraising thresholds, e.g., PLN 20,000 or PLN 50,000).
1. The Beneficiary and their family have the right to respect for their dignity, privacy, and intimacy during the provision of assistance.
2. The Beneficiary (or their guardian) is obliged to:
1. The "Ostatnia Warta" Foundation, its Volunteers, and individuals acting as End-of-Life Doulas provide support of a strictly non-medical nature.
2. We are not healthcare professionals, we do not diagnose, we do not decide on the course of clinical therapy, we do not perform invasive nursing procedures, nor do we prescribe or administer any medications (including painkillers).
3. Our activities complement, but do not replace, medical and hospice care. We rigorously respect the boundaries of competence of qualified medical personnel (doctors, nurses).
4. A Volunteer has the right to interrupt their shift and leave the place where assistance is provided at any time if they believe the situation threatens their health or if they are forced by their surroundings to exceed their non-medical competencies.
1. The termination of assistance occurs naturally upon the death of the Beneficiary, resignation from the Foundation's support, or the cessation of the premises on which the assistance was granted.
2. The Foundation reserves the right to immediately suspend or terminate assistance in the event of:
1. The data controller of the personal data of Beneficiaries and their families is the Foundation. Data is processed with the utmost care for confidentiality, exclusively for the purpose of the assistance and fundraising process. Details are specified in our Privacy Policy and GDPR.
2. In matters not regulated by these Regulations, the provisions of generally applicable law apply, and final resolving decisions are made by the Management Board of the Foundation.
3. Any disputes will be resolved amicably, and in the absence of an agreement – by Polish common courts competent for the seat of the "Ostatnia Warta" Foundation in Gdańsk.
